The same is true for any and all AI's that you use to help write your draft filings: The AI is not practicing law. The AI is not a law firm. The AI is not providing legal advice. The AI is not knowledgeable in your technology because you (and any co-inventors) have created a new invention that the AI cannot know or understand. The AI is not able to describe a technology it does not know. The AI is not creating a patent filing for a technology it does not know or understand.
Since a patent draft is confidential description of a novel and unique invention, no one knows it except you. This means you (and your co-inventors) are the only person in the whole world who can:
- You are the only person in the world who can guide AI in drafting the various parts of your patent disclosure and your patent draft, so you are responsible for reviewing and editing the descriptions AI produces, so it is an accurate and clear description of your invention
- You are the only person in the world who can confirm the factual statements made by AI, and the references cited by AI, so you are responsible for using AI to produce an accurate and clear description of your invention
- Today's AI's are known to produce errors, falsehoods, biases, hallucinations and other issues, so you should expect the AI to make a variety of mistakes in its drafts, so you are responsible for identifying these and correcting them
- Many of today's AI's can include inputs with limited lengths, and produce outputs with limited lengths, so as you produce various parts that you judge to be accurate, clear and sufficient, you are the only person in the world who knows your technology and can combine those parts with each other and any other parts you want to include, to draft each filing for your patent attorney to finish and file with the appropriate patent office (s).
Therefore, we are not (1) not practicing law in any way, (2) not your attorney or legal advisor, (3) not assisting you in determining if your patent filings are clear descriptions or accurate representations of your invention, (4) will or will not be approved by any patent examiner or patent office, (4) not writing any part of your patent filing for you, (5) etc.
